Naturalization & Citizenship

How you acquire the U.S. Citizenship?

The laws of the United States provide that a person may be granted with U.S. citizenship under certain circumstances such as: (1) birth in the U.S.; (2) the citizenship of one or both parents; or (3) a combination of where parents were located and parental citizenship. Lawful permanent residents (or green card holders), who satisfy the requirements, can file application for citizenship. However, sometimes to apply for US citizenship may not be easy at all, the applicant may have criminal records, traffic violations, or even worse DIU (Driving Under Influence). Thus, an attorney is recommended, even if the process seems easy an attorney is the right person to file an application for citizenship.

Mistakes may cost a lot of money and time

Remember that if there is any mistake in filling your forms or in gathering the evidence may result in denial of your application or sometimes your citizenship may be denied if you do not have the professional guide of an immigration attorney..

Benefits of Citizenship

Just to finish, do not forget the importance of Citizenship: “Many invaluable benefits flow from United States citizenship, including rights to vote in federal elections, to travel internationally with a U.S. passport, to convey citizenship to one’s own children even if they are born abroad, to be eligible for citizen-only federal jobs, and indeed, to be free of discrimination by Congress on the basis of alienage. [O]nce citizenship has been acquired, its loss can have severe and unsettling consequences.’ Fedorenko, 449 U.S. at 505.… Denaturalization ‘may result in the loss of both property and life, or of all that makes life worth living.’ U.S. v. Minker, 350 U.S. 179, 187
(1956).” See Ira J. Kurzban, Kurzban’s Immigration Law Sourcebook 2149 (16th ed. 2019).

Federal Government’s Recommendations

The Federal Government recommends the following: “If you, or someone you know, is trying to sort out immigration issues, go straight to an immigration lawyer and skip the notarios. They’re not lawyers, and cannot help with immigration. Instead, time after time, we see stories of notarios who take people’s money and documents, make big promises, and then do nothing. Often, they hurt your chances of immigrating lawfully while they disappear with your papers and cash.” See available at https://www.consumer.ftc.gov/blog/2019/09/notarios-are-no-help-immigration

About Notario Fraud

The American Bar Association (“ABA”) which “promotes the best quality legal education, promote competence, ethical conduct and professionalism, and promote pro bono and public service by the legal profession,” is educating people to prevent them to be victims of misrepresentation by the known “notaries.” ABA stated that: “Individuals who represent themselves as qualified to offer legal advice or services concerning immigration or other matters of law, who have no such qualification, routinely victimize members of immigration communities. Such representations can include false statements that: The individual is an attorney, or abogado; the individual is authorized to represent immigrants before the United States Citizenship and Immigration Service (“USCIS”), or before immigration courts; the individual is qualified to assist in preparing a will, corporate document or other legal paperwork; the individual is a legal assistant; the individual has a court license; or the individual is a notario publico. See available at https://www.americanbar.org/groups/public_interest/immigration/projects_initiatives/fight-notario-fraud/about_notario_fraud/
